In January 2021, Kapelushnik was arrested on robbery charges after he stole a man’s phone at The Fontainebleau Hotel at Miami Beach on New Year’s Eve.
The incident occurred when Benjamin and his entourage accused a 19-year-old of taking his photo without his permission while inside the hotel. Benjamin followed him outside and eventually grabbed the device. The man denied taking a photo.
”Internet fame or celebrity grants no one the right to violate the law,” Katherine Rundle, the State Attorney for the 11th Judicial Circuit of Florida for Miami-Dade County said on Twitter. ”The actions that put our victim in the hospital are crimes, plain & simple. Social media personality Benjamin Kapelushnik has been charged with Strong Arm Robbery.”
One of the victim’s friends was able to retrieve the device.
